Apple sued for not paying employees according to the rules

 


Apple is facing a class action lawsuit by a former employee for not paying wages according to applicable law.

Raven Ramos is a former Apple Store employee located on Fifth Avenue, New York. He sued on behalf of himself an Apple employee who currently works in New York.


Known in the state of New York has a law that requires companies to pay manual workers every week. This applies to employees who are engaged or have engaged in manual work during their tenure.



However, a company may receive authorization from the Commissioner of the New York Department of Labor to pay its workers on a half-monthly basis.


Launching from 9to5mac, Thursday (7/4/2022) the document states that Apple does not have authorization to pay on a semi-monthly basis. The Cupertino-based company has many stores in New York and employs more than thousands of employees in the state.

According to the class-action complaint, at least 25% of Ramos' work assignments at the Apple Store involve manual labor. This includes working on the sales floor, opening product boxes, emptying cash registers, and helping customers.


Apple's failure to pay wages on time also caused Ramos to lose the time value of the money.


Ramos, who is a local resident of Port Chester, New York, worked for Apple from October 2010 to January 2018 and was paid semi-monthly around the clock.


This class action lawsuit covers at least 100 employees in which the total claims of each employee are more than USD 5 million.


Those involved are seeking to receive the amount of their wages paid prematurely in liquidated damages from Apple. It also seeks reasonable attorney's fees and costs, and pre-assessment and post-judgment interest.
