Before Nintendo officially announced their Nintendo Switch 2 console a few months ago, it was leaked in advance at CES 2025, through a video game accessory company called Genki.
Nintendo said that Genki had infringed on Nintendo's trademark rights and acted in falsely marketing their products, specifically by claiming that their accessories could be used with the console, even though Genki allegedly did not have access to the console at the time.
Many reports and articles were shown after Genki showed the Nintendo Switch 2 mock-up, where Nintendo was not only forced to issue a statement saying that it was not an official mock-up by Nintendo, but also released a promotional video in advance to curb "fake news" about the Nintendo Switch 2 console design.
Genki later said that they did not use an illegally obtained mock-up console, but were built using design details leaked on the web. Nintendo's lawsuit against Genki includes this statement, but Genki also said that nothing has changed, as their accessories will still support the new console's design.
Genki said that they will use their legal services and will take this lawsuit seriously, saying that they will issue a statement about it later.
Pre-orders for the Nintendo Switch 2 console are already open in Japan and the United States, where it is expected to officially arrive in the Malaysian market around July-September.
