Having just launched a new product, Insta360 seems to be facing a “black episode” when DJI has filed a lawsuit against the company in Texas Federal Court over the Luna camera series, which allegedly infringes on Osmo Pocket technology patents. The lawsuit, filed in June 2026, claims that the Luna and Luna Ultra models ‘completely copy’ DJI’s patents used on the Osmo Pocket.
The case involves two types of patents, namely ornamental design patents and functional patents. Functional patents are legal protections for the way a product operates and the technology used in it. In the case of the Luna camera, they include gimbal controls, subject tracking systems, real-time displays, and switching modes.
Simply put, functional patents protect how a product works, not just its external appearance. Infringements of this type of patent are considered serious because they affect the patent owner’s full right to use and sell the technology they developed on the market. This type of patent is also very important because it protects inventions that can be used directly in products.
This situation also raises a big question. If DJI wins in their lawsuit against Insta360, what will be the impact on other brands that design products with similar concepts? This DJI and Insta360 case seems to be a starting point that determines how brands like Oppo or Vivo organize their strategies in the more or less similar product market in the future.
